RIAA's
New Target
Billboard reports:
The Recording Industry Assn. of America has filed an amended copyright-infringement
suit against the owners of a flea market in Columbus, N.J., who the trade
group claims "flagrantly and repeatedly ignored numerous demands to curtail
the sale of pirated CDs and cassettes."
The suit was initially filed in June; the amended action-listing more than 7,500 works whose copyrights were allegedly infringed-was filed Oct. 1 in U.S. District Court for the District of New Jersey.
The RIAA says piracy at the Columbus Flea Market, one of the largest on the East Coast, remains rampant despite three raids by police, in which 26 vendors were arrested and 16,000 allegedly illegal recordings were seized. The RIAA says it has sent five letters to the market's managers and met with them last year to offer training on how to eliminate pirated music. -- Click Here for the Full Story
It was learned today that the RIAA began suing preschoolers overheard huming or singing songs copyrighted by RIAA artists. One anonymous spokesperson said "Why would these childred buy the cd's when they can hum the songs to each other? It's hurting artists".

Billboard reports:
The release of an expanded edition of Weezer's 1994 self-titled Geffen
debut and a comprehensive DVD has been pushed to next year, according to
the band's official Web site (http://www.weezer.com).
The items were tentatively expected during the holiday season but were pushed back "due to overall schedule planning at the record label," the site says.
The DVD, "Video Capture Device," will run "well over three hours, even after several bits and pieces came out in the final legal wash." As for the new edition of "Weezer," it will be a two-disc set loaded with "extra songs both well-loved-yet-somewhat-obscure, as well as downright previously unheard stuff." .- Click Here for the Full Story

Side of Godsmack
VH1 reports: The
upcoming Godsmack acoustic EP will be called The Other Side, an appropriate
title coming from a band whose frontman sings about having out-of-body
experiences on its next single, "Realign." Yet Sully Erna had no spiritual
motivation when he conceived the name.
"It's an acoustic record so it's just the other side of us than the one people are used to hearing," he said.
The Other Side, which comes out November 18, features seven tracks recorded earlier this year in Hawaii after the band finished its tour of Asia.- Click Here for the Full Story

Maiden Drummer Faces Assault Charges

IRON MAIDEN drummer Michael "Nicko" McBrain will appear in Hempstead District
Court in New York next month to face third-degree assault charges. On Tuesday
(October 7), a judge set a November 7 date for the case, which involves
McBrain intentionally running his car into a parking-lot attendant before

Machine Head's entire upcoming new album "Through The Ashes Of Empires"
has been Posted online in streaming audio at Metal Hammer. The album will
be released through Roadrunner in the U.K. on October 27th, while a label
for a North American release of the effort has yet to be decided upon.

OF A DOWN have begun work on their next album.
The post-metal outfit of Serj Tankian, Daron Malakian, Shavo Odadjian and John Dolmayan are currently writing and rehearsing in Los Angeles, and plan to start recording in early 2004 with a view to releasing an album by the end of the year.
The last time the band were together writing new material was for sessions that became 2001's breakthrough LP 'Toxicity'. Last year they released the rarities compilation 'Steal This Album'.- Click Here for the Full Story

Island's Thrice and Thursday will appear in select Apple stores to play in store sets during their upcoming tour. Tracks from their sets, recorded on the spot, will then be available for download exclusively on Apples iTunes music store.
Thrice will play
at Santa Monica's Apple Store, while Thursday will play the branch in New
York's SoHo.

MORBID ANGEL will join the upcoming SUPERJOINT RITUAL North American tour
as main support beginning on November 3 in State College, Pennsylvania.
DEVILDRIVER, the new band fronted by former COAL CHAMBER singer Dez Fafara,
are expected to fill the opening slot on the entire trek, which is slated
to kick off on October 16 in Columbus, Ohio. There is no word yet on who
will occupy the middle slot on the tour prior to November 3. SEPULTURA,
who were previously announced as the main-support act on the tour, have

reports: It's been 2-1/2 years since the Island Def Jam Music Group acquired
a 50% stake in Roadrunner Records. However, the longtime rock-metal independent
label still feels like an indie despite its major label parent, president
Jonas Nachsin says.
"In terms of the Roadrunner's indie spirit, I don't think we've lost any of that," Nachsin says. "When the partnership was done, I think the first thing that was decided was not to do anything, which was a very sage and important game plan because when something is working, the last thing you want to do is start to mess with it."
It was a major shift for Roadrunner, which was founded in 1981 in Amsterdam by its chairman Cees Wessel and made a name for itself by doing outside-of-the-U.S. licensing deals with such metal bands as Metallica, Slayer and Megadeth. The company opened its first U.S. office in 1986 and went on to become home to such bands as Fear Factory, Type O Negative, Coal Chamber and Slipknot.
"We have achieved
much more than I think people would have initially thought we were capable
of," Nachsin says. "The obvious recent examples are with Slipknot and Nickelback.
I really believe the company has two of the elite bands of the rock universe."

reports: Tampa's Hell On Earth will perform live at the Brass Mug on Sunday,
October 12th. When asked about the concert, lead singer, BillY Tourtelot
answered, "I can not and I will not talk to you about what will or will
not happen during our performance. We have a concert this Sunday night."
According to Tourtelot, he has personally invited select individuals, as special guests of the band, for a back-stage meet-and-greet after the show. Response: We get this on the fan speak too. 1) The Day In Rock is just that, the day in "ROCK" so we try to stick to rock related news. Sorry we're not Rolling Stone and don't consider everything that sells magazines rock. And rock is still very cool.
Another good question we often get asked that goes along with this is "How come (insert artist name) isn't covered here?" That's a good and fair question. The reason is we have to know about it. We have a pretty good list of major and top indie rock sites we draw from as sources but we can't check them all! The Southern California band Gameface has decided to call it quits.
Gameface has been a seminal band in the pop-rock community for the past 13 years. After releasing 12 records on 5 US labels, Gameface joined forces with Doghouse Records to release, Four To Go, on August 12, 2003.
"Four To Go is our best record so far, and a reward for staying together as a band for all these years", Jeff stated about their last masterpiece.
We are all very sad about the current state of Gameface. We will cherish their albums and always remember their energetic live shows.

Tori Amos has announced a new business venture. The move aims to
assist the creative development of an artist as record labels spend more
and more time dealing with how to approach the changing environment of
the music industry. Her solution: The Bridge Entertainment Group,
a project development company that can help musicians deal with anything
from creating an album marketing campaign to putting together a tour.
Whether an artist might find themselves between management, not ready to
commit to a long term management agreement, or dealing with the revolving
door of a record label where the creative core could change at any time,
The Bridge can be there to make sure details are taken care of during an
interim period, whether hired by the artist themselves or as a place for
management companies and record labels to outsource projects. "When
the dust settles new paradigms that support artists must be created. What
we've lost is artist development, tour development, image development and
how to be a bridge in a music industry that is attempting to redefine itself
but hasn't quite achieved that yet," says Amos.
