Limp Bizkit Sued By Fans
From Blabbermouth: The Smoking Gun reports that LIMP BIZKIT were sued Wednesday (October 8) in Chicago by 172 concertgoers who claim they were ripped off when the rap/rock group ended a July performance after only 17 scintillating minutes. According to the below Cook County Circuit Court lawsuit, LIMP BIZKIT cut short their set at Cicero's Hawthorne Racetrack after instigating fans by displaying "obscene and profane messages to the crowd via four giant monitors." The complaint also alleges that LIMP BIZKIT frontman Fred Durst yelled "disgusting homophobic and anti-gay statements" at the crowd, and continued his vulgar diatribe even after the group fled the stage (Fred took his mic with him). The breach-of-contract suit, filed by attorney Michael Young, seeks a $25 refund for each attendee at the July 26 show, which also featured LINKIN PARK and headliner METALLICA. According to the complaint, 40,000 people attended the "Summer Sanitarium Tour" stop, tickets to which cost $75. -- Click Here for the Full Story

Napster Gets Legit
AP reports: The Napster name, once synonymous with the digital song-swapping bazaar that incensed the recording industry, revives Thursday as an Internet music store that will go head to head with such competitors as Apple and MusicMatch. 

Santa Clara-based Roxio Inc., which bought the rights to the Napster name for about $5 million, has shelved its former online music service, pressplay, and plans to move subscribers to a beta, or working version, of Napster 2.0 beginning Thursday. 

Napster 2.0 will be available to the general public within a month, according to sources familiar with the plans. 

Roxio is betting the Napster brand will help set its service apart from a bevy of other digital music retailers that have launched since Apple Computer Inc. introduced its iTunes Music Store in April.

The space has become crowded because there's a recognition of this is going to be a very substantial business," Chris Gorog, Roxio's chairman and chief executive, told The Associated Press. "It validates Roxio's strategy to enter this business."

Gorog did say that while the service will incorporate some usage restrictions, he believes most users won't notice them. 

"Ninety-nine percent or more of our Napster users will never bump their heads against any usage rules," Gorog said. "They're going to be in an environment where everything costs the same, where every song that they select they can burn to a CD or offload to their device, they can do it multiple times and they won't even know what the usage rules are because they are so flexible."- Click Here for the Full Story

Springsteen Vs. NYPD 
AP reports: Is Bruce Springsteen making the NYPD blue (news - Y! TV)? 

The New Jersey rocker closed out his recent world tour with three shows at Shea Stadium, where he reportedly aggravated city police by performing "American Skin (41 Shots)" � a song inspired by the 1999 shooting of West African immigrant Amadou Diallo by four officers. 

After Springsteen played the song during the Oct. 1 opening night, a high-ranking police official ordered that there would be no post-concert police escort for the Boss after his next show, the Daily News reported. 

After Springsteen debuted the song during his 2000 tour, the Patrolmen's Benevolent Association � representing 27,000 police officers � urged its members not to attend Springsteen's 10 Madison Square Garden concerts. - Click Here for the Full Story

Death By Stereo Face Charges?
siN's metal news: DEATH BY STEREO look certain to face legal action over the recent disaster which took place on Sunday September 28th in Blacksburg, Virginia, USA where some of the band's fans fell through a window from the second story of the venue onto the concrete patio below. A recent report indicating the severe implications of the deaths has been released:

"The total of people who have died after last week's house show at Solar Haus has reputably risen to three. The band took time out from their US tour to try to come to terms with the tragedy. This has hit the band very hard as they may be held accountable for the deaths, there is a strong possibility that the band will face legal action as a result of this, either from being sued by the parents of the victim's or by the owners of the house. The band stand to lose a lot of money and as a result my not be able to continue."

Spector To Flee Justice?
Launch had this one today: The New York Daily News reports that legendary '60s record producer Phil Spector, who was arrested in February on suspicion of killing actress Lana Clarkson at his California mansion, may have plans to flee the U.S. before his October 31 hearing.

Los Angeles law enforcement officials reportedly received a tip from a member of Spector's camp. A source told the newspaper, "Spector has a private jet. The sheriff's office has been told that he might use it to take off. The police said they appreciated the information, but that they didn't have the manpower to keep watch on him 24 hours a day." Just last week, a Los Angeles Superior Court judge extended Spector's $1,000,000 bail to the date of his hearing.

Despite the tip, some L.A. officials are not too concerned with Spector leaving the country. Captain Frank Merriman, head of the L.A. sheriff's homicide bureau, said, "If we felt it was necessary to watch him, we would. I'm not worried about him. If he's charged, he'll either turn himself in or he'll flee. But where's he's going to go? Let him run. We'll catch him.".- Click Here for the Full Story

NBC & Vivendi Merge
After months of negotiations, NBC is getting its prize: Membership in the Big Media Club. 

NBC, a unit of General Electric Co., sealed a deal to merge with the entertainment businesses of Vivendi Universal, the companies announced Wednesday, creating a media conglomerate in the same class as giants like Viacom Inc. and Walt Disney Co. 

The new company, to be called NBC Universal, will have a leading broadcast network, the Universal movie and television studios, 14 local TV stations, an array of cable networks including USA, CNBC and Bravo, and interests in five theme parks. 

With $13 billion in annual revenues, NBC Universal will still be small compared to the largest media conglomerates like AOL Time Warner Inc., which had $41 billion in revenues last year or Walt Disney Co.'s $25 billion. 

Universal Music Group, the largest music company, is not part of the deal and will be retained by Vivendi.

Chimaira and Soilwork's Pure Hatred
Digital Noise reports: Chimaira and Soilwork will be teaming up for "Pure Hatred" tour which is scheduled to kick off on November 18th and run through December 22nd.

Other bands that are expected to appear on the tour are Cannae (November 18th - 22nd), As I Lay Dying (November 23rd - December 22nd) and Bleeding Through (November 20th - December 22nd).

Blabbermouth reports: MACHINE HEAD frontman Robert Flynn has posted the following message to the band's official web site:

"After reading a recent article that referred to the music of LAMB OF GOD as 'Nu-Metal', I am officially retiring the word 'Nu-Metal' from my vocabulary. It is THE most played out, overused and generic term, OF ALL F**KING TIME!

"Just wrapped up the 'Imperium' video shoot yesterday. Man, at 3 days, that was the longest video shoot we've ever done. Had a blast doing it. Got a REAL good feeling about this video, man. We shot at 8 different locations, warehouse, white room, blood red room, Metal tree, bunch of others. Mike Sloat directed it. He's not a big name director or anything, just a young, super hungry, talented up-and-comer, who had really, really good ideas and was able to make our ideas come to life. We'll have a 'Making of the Imperium video' up on the site in a few days.

Coldplay Legal Play
Muchmusic reports: Chris Martin of Coldplay wasn't in an Australian court on Wednesday but his lawyer spoke on his behalf and has asked that Australian police drop a charge of malicious damage that he is facing. The singer was charged back in July after he allegedly smashed a car windshield after being snapped surfing by a photographer. Malicious damage carries a maximum sentence of five years, the case will continue on November 21.- Click Here for the Full Story

Nope, get this the female rockers selected by RS who "rock" are Missy Elliott, Alicia Keys, Eve and Lauryn Hill. INXS Lose Another Singer
Undercover reports: Jon Stevens has announced his departure from INXS before they even release their first album together.

Stevens made the surprise announcement on The Today Show this morning when he dropped the news on interviewer Richard Wilkins. Wilkins and Stevens, both former Kiwi 70s pop stars, had known each other for a long time since they came up through the ranks of the New Zealand music industy together.

"We thank Jon for his incredible input in the past three years and for helping us through the difficult transition following Michael's death" INXS said in a statement." We've had some great gigs and great tours and will always value his contribution". 

The band cite musical differences as the reason for the split with Jon. "At this point we have different views of our future and have mutually decided it is in our best interests to part ways. Original Omen Vocalist J.D. Kimball Passes Away
J.D. Kimball, the former lead singer of Omen, passed away on October 3rd, 2003 after a 3-year battle with cancer. Omen guitarist, Kenny Powell, would like to share these words about his former bandmate: "He was a great writer, one of the true innovators in the early years of power metal. I am extremely proud of the records that we did together, "Battle Cry", "Warning of Danger", "Nightmares" and "The Curse". I hope everyone will remember J.D. for all of his truly great contributions to the world of Heavy Metal.
